Just barely though. 4 judicial activists dissented.
We all know the story (if you don’t, it’s all over the web), whitey took the test, whitey passed the test, the test was thrown out because there were too many whiteys. Whitey sued, it was rejected, so they took it to the top.
If I were a minority, I would be angry at the folks who were supposedly defending me. Was the test too hard for non-whites? No. How could that be? Was there some kind of trick or bias that only whitey could navigate? That was the New Haven’s defense. Well, at least they had a defense, as weak as it was. Sonia Sotomayor blew this case off with such disdain that even one of her mentors was taken aback.
Discrimination is what is it no matter who you apply it to. Affirmative action is gone-it’s no longer necessary. Any of those firefighters had the same chance of passing. Or did they? Apparently, one of the white guys was dyslexic, and he had a hell of a time getting ready for this thing. He did it though. Blood and guts and sheer determination. You think that guy has some advantage over a “minority?”. I use that term loosely, because as I understand it, whites are the minority in New Haven. Correct me if I’m wrong there.
It’s too bad anybody had to defend their skin color. Sotomayor will probably be confirmed as the token Latina on the Supreme Court, so expect those 5-4 decisions to continue. Well, what do you expect from her? Obama himself said he was looking to make a race based decision when he picked her. Are you surprised at what he picked?










Well, some minorities did pass the test. A hispanic was one of the plaintiffs in this suit. They tossed the tests because no blacks, to use a golf term “made the cut.” The test was passable.
Sad that New Haven was so afraid of the Jeremiah Wright “blacks are wired differently” crowd that they tossed the test, but dared whitey to come after them. Whitey took that dare.
This has to be a little embarrassing for Obama, he was hoping that this decision would not come down until after Sotomayor’s confirmation hearing.
