Does the rule of law even matter anymore? Does a mountain of evidence and a compelling argument have any place in a courtroom? Apparently, not in the United States anymore. Case in point, the state of Alabama. In trying to protect their state from the onslaught of illegal immigration, their efforts have been thwarted by the federal government-with a little help from their friends.
Like something straight out of a Rick Perry wet dream, the 11th U.S. Circuit Court of Appeals showed their judicial activism and blocked key parts of the new Alabama immigration law, lauded as the toughest in the nation. After another judge had trimmed it down a weeks ago, the 11th Circuit all but gutted the rest, once again leaving Alabama exposed to a punishing wave of immigration that sparked the law in the first place.
On orders from the Justice Department, the court blocked Alabama from checking the immigration status of students enrolling in the state. Can’t even ask. While police can still try and determine legal status in the event of a lawful stop or arrest, immigrants do not have to carry identification showing that they are indeed legal residents. That effectively guts anything the police can do when arresting an illegal alien criminal. No ID, you go free.
The federal government is refusing to enforce immigration law, and going out of their way to make sure states can’t do it either. In fact, the JD argues that the states have no right to enforce immigration law.
The Obama administration says the Constitution does not permit states to deter illegal immigration, saying an issue with foreign policy implications is the exclusive mandate of the federal government.
Funny, the Obama regime is taking orders from the Mexican government, while at the same time having the Sinaloa cartel empty clips into the skulls of the poor saps who didn’t make it across the border.
So while this case, like Arizona, Georgia, Indiana, and a few other states, languish in the courts, the border remains wide open-except for the areas the cartels troll. They provide as much-if not more security than the United States government. Not that the cartels planned it that way, but potential border crossers are just afraid of crossing paths with vicious goons armed by Eric Holder. For those that do get through, they can expect free health care, education for their children-including college, American jobs and subsidized housing. All they have to do is cast a vote for their favorite Democrat every election.
The Obama regime argues that states do not have the authority to enforce immigration law. They argue that is federal jurisdiction. At the same time, the regime is silent when states like California pass their own DREAM Act, have open sanctuary cities, and even issue special ID’s just for immigrants so they can conduct business illegally in the state. Enforcing the law will get you a date in court, but blatant violation of those same laws draw no response at all.
I ask again, does the rule of law matter? No, it doesn’t. All you have to do is get yourself in front of an activist judge and you can do whatever you want. If you can’t afford to litigate yourself in front of an activist that sees things your way-you lose. Better hope somebody sees you as a useful idiot and gives you defacto justice while pursuing their own agenda. Even when the Obama regime is deposed, these judges will remain-for life. Add to that, half the country isn’t even on board with the guiding principles of the country (The Constitution), and the government, the legislature, the judiciary, the schools, the unions and many states are all subverting from within with their Marxist dream, of which open borders is a major piece.
Voters are coming from abroad, and being cranked out of Marxist school mills as we speak. The future is now, and when the tipping point comes (we’re already 50/50), there won’t be much left to fight for. Those that would see this country destroyed see an aging, shrinking, broke country. They’re going in for the kill. This is that moment in history. Alabama sees that and is trying to do protect their little piece of the universe. Barring some miracle, it won’t happen through the courts. There may have been time 30 years ago, but not now. Good luck Alabama, and God help the rest of us.






I seems that there is nothing states can do while Obama is in office.
Question: Do not not states assist in the enforcement of other federal laws? If so, the states should stop assisting and say its a federal issue, do it yourselves.
Well, Obama isn’t the only one for open borders. That’s the problem, there are legions to take his place when he goes.
So far, precious little conversation about our borders from the Candidates. Except for Perry, and that didn’t go so good.
I’m glad the issue did come up with Perry. Otherwise there would have been no discussion at all. Now the candidates know how the voters feel and they have to address it, because they’ll be put on spot at campaign stops.
The Obama administration has no intention of enforcing our immigration laws. As it has been with the DOMA and other laws that they do not agree with, they seem to be more than willing to pick and choose their poison, ie. which laws they will enforce. It has to be very frustrating for states such as Alabama and Arizona, having taken steps to alleviate a problem, only to have the courts and the federal government step in and say they can not proceed.
They’re fighting though, LD. It would have been much more disappointing to see them just give up. I think that’s where we’re at. Saving individual states. I don’t think we can save all 50. The numbers are just too daunting at this point.
This is not surprising but is still disappointing. The Obama regime feels as if it is up to the feds to enforce immigration law, but at the same tme refuses to enforce the law, and I find it unfogivable.
I had the same problem with Bush, so I don’t think we can rest easy even with a Republican in the White House. First things first though.
